RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05629 COUNSEL: NONE HEARING DESIRED: YES ________________________________________________________________ APPLICANT REQUESTS THAT: Her Fitness Assessment (FA) dated 5 Sep 12, be removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: She was not measured properly by the Fitness Assessment Cell (FAC) personnel, resulting in her not achieving a passing score. She told the FAC member that her height and weight measurements were not correct; however, her measurements were not retaken. She was re-measured a week later by a different FAC member [witnessed by the Unit Fitness Program Manager (UFPM)], and her measurements were, height (66 inches) and waist (30.5 inches). In support of her request, the applicant provides copies of her AF Form 469, Duty Limiting Condition Report, FAC Score Card sheets, Fitness Calculator printouts, Report of Individual Fitness Sheet, a letter to her commander, and a Memorandum from the FAC. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of master sergeant. Air Force Instruction 36-2905, Fitness Program, Air Force Guidance Memorandum 4, Paragraph 7d states that “The tester will take the circumference measurement three times and record each measurement rounding down to the nearest one half inch. The tester will add the tree closest measurements, divide by three, and round down to the nearest one half inch. The tester will record this value as the abdominal circumference (AC) measurement.” ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial. DPSIM states that the applicant has not provided sufficient evidence that would indicate the 5 Sep 12 AC measurement did not comply with the Air Force Instruction. The fact that the subsequent measurements were lower does not invalidate the 5 Sep measurement. The complete DPSIM evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: She contested her height and waist measurements with the male FAC member who conducted the measurements; however, there was only one other FAC member present at the time and he was taping, weighing, and measuring male testers. She understands that waist measurements can fluctuate depending on who takes the measurement, how much a person weighs, and other variable factors. Although her weight fluctuated by two pounds, she does not believe that was a sufficient enough weight loss to achieve a 1 1/2 inch to 2 inch decrease in AC. An adult’s height normally does not change in a one to two week span. Her normal height is 66 inches. The memorandum from the FAC noncommissioned officer in charge (NCOIC) states that “All FAC personnel have been properly trained to perform testing over all components of the FA, but are inclined to make mistakes.” The memorandum also verifies that she did complain to the FAC tester, and that she was not directed to the NCOIC or any other FAC personnel to have the issue resolved. Had proper procedures been followed and she was re-measured when she questioned her AC and height measurements, she believes she absolutely would have passed her FA. Based on the documented inconsistencies in her height and weight measurements over a two-week period from 5–19 Sep 12, and the memorandum from the FAC, she respectfully requests that the FA failure be removed from the AFFMS. The applicant's complete response is at Exhibit D. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting corrective action. After careful consideration of the evidence of record and the applicant’s complete submission, we find it sufficient to grant relief. We note the office of primary responsibility recommends denial based on the fact the applicant did not provide sufficient evidence that would indicate the 5 Sep 12 abdominal circumference (AC) measurement, was not in compliance with appropriate guidance. However, the applicant provides a memorandum from the Fitness Assessment Cell (FAC) NCOIC, stating that had the applicant’s complaint been directed to the NCOIC or any of the FAC personnel at the time it occurred, it could have been resolved immediately. Therefore, in view of the above and in the interest of justice, we find the evidence sufficient to grant the requested relief and recommend the records be corrected as indicated below. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issue involved.
